1. Description of Service

WildID is an AI-powered mobile application that assists users in identifying wild animals from photographs. The App uses artificial intelligence and machine learning models to analyze images and provide estimated identification results, including species information, habitat details, safety considerations, and other related content.

2. Acceptance of Terms

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and WildID.

3. Eligibility

You must be at least 13 years of age (or the applicable age of consent in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this eligibility requirement. If you are under the age of 18, you represent that you have obtained parental or guardian consent to use the App.

4. User Responsibilities

By using the App, you agree to:

• Use the App only for lawful purposes and in accordance with these Terms.
• Exercise extreme caution around wildlife. Always maintain a safe distance from any animal, regardless of the identification results provided by the App.
• Never approach, touch, handle, feed, or provoke any wild animal based on information provided by the App.
• Seek professional help immediately if bitten, stung, or injured by any animal, regardless of whether the App identifies it as dangerous or safe.
• Not use the App while in an unsafe situation or in a manner that could endanger yourself or others.
• Not reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Not use the App for any commercial purpose without our prior written consent.
• Not upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable.

5. AI-Generated Content Disclaimer

5.1 No Guarantee of Accuracy

The identification results, safety assessments, species information, habitat details, behavioral descriptions, and all other content generated by the App are produced by artificial intelligence models and are estimates only. We make no representations or warranties regarding the accuracy, completeness, reliability, or correctness of any AI-generated content.

5.2 Not Professional Advice

The App does not provide:

• Professional wildlife identification or taxonomy services.
• Veterinary, medical, or first-aid advice.
• Emergency services or professional safety guidance.
• Certified conservation or environmental assessments.

Always consult qualified professionals for matters of safety, health, and wildlife management.

5.3 False Positives and Negatives

The App may:

• Incorrectly identify a dangerous animal as safe (false negative).
• Incorrectly identify a safe animal as dangerous (false positive).
• Fail to identify an animal entirely or provide incorrect species information.
• Provide outdated or region-inappropriate safety information.

You acknowledge and accept these risks by using the App.

6. Subscriptions & Payments

6.1 Free & Premium Plans

The App offers both free and premium subscription plans. Free users are subject to daily usage limits. Premium subscribers receive access to unlimited analyses and additional features.

6.2 Billing

• All payments are processed through the Apple App Store or Google Play Store ("Platform").
• Subscription fees are charged according to the plan selected at the time of purchase.
• Prices may vary by region and currency, and are displayed in your local currency at the time of purchase.

6.3 Auto-Renewal

• Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period.
• Your Platform account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscription at any time through your device's subscription settings.

6.4 Free Trials

• If offered, free trial periods automatically convert to paid subscriptions upon expiration unless cancelled at least 24 hours before the trial ends.
• Any unused portion of a free trial period will be forfeited upon purchasing a subscription.

6.5 Refunds

Refunds are handled exclusively by the Apple App Store or Google Play Store in accordance with their respective refund policies. We do not process refunds directly.

7. Intellectual Property

• The App, including its design, features, content, code, algorithms, and AI models, is the intellectual property of WildID and is protected by applicable copyright, trademark, and intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
• You retain ownership of any photos you submit. By submitting photos, you grant us a limited, non-exclusive license to process them for the purpose of providing identification services.

8. Limitation of Liability

• The App is provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
• We shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, the App.
• We shall not be liable for any harm, injury, death, property damage, or loss arising from your reliance on or actions taken based on the identification results, safety assessments, or any other information provided by the App.
• We shall not be liable for any inaccurate, incomplete, or incorrect identification results produced by the AI models.
• We shall not be liable for any damages resulting from interactions with wildlife, regardless of whether the App was used in connection with such interactions.
• Our total liability, if any, shall not exceed the amount you have paid for the App or subscription in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless WildID, its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including attorneys' fees) arising from:

• Your use of the App.
• Your violation of these Terms.
• Your interaction with any wildlife or animals.
• Any actions you take based on information provided by the App.
• Your violation of any applicable law or regulation.

10. Assumption of Risk

By using the App, you expressly acknowledge and assume all risks associated with:

• Relying on AI-generated identification results.
• Interacting with or being in proximity to wild animals.
• Acting upon safety or behavioral information provided by the App.
• Using the App in outdoor or potentially hazardous environments.

You understand that wildlife can be unpredictable and potentially dangerous, and you voluntarily assume all risks associated with any wildlife encounter, regardless of the information provided by the App.

11. Service Availability

• We do not guarantee uninterrupted or error-free operation of the App.
• We reserve the right to modify, suspend, or discontinue the App or any part thereof at any time, with or without notice.
• We are not liable for any modification, suspension, or discontinuance of the App.

12. Termination

We reserve the right to terminate or suspend your access to the App at any time, without prior notice, for any reason, including but not limited to violation of these Terms. Upon termination, your license to use the App is immediately revoked.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Turkey.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WildID regarding your use of the App and supersede all prior agreements, understandings, or representations.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting updated Terms within the App. Your continued use of the App after any such changes constitutes your acceptance of the modified Terms.
